In pratica, in tale caso non sussiste alcun collegamento diretto tra il mezzo con il quale il reato è stato commesso e l'abuso dell'autorizzazione amministrativa, in conseguenza del quale va applicata la sanzione accessoria (Cass. Sez. IV, 17 marzo 1999, n. 867).
Diversamente nell’ipotesi in cui il conducente del mezzo non risulta titolare del documento di abilitazione alla guida, la sospensione della patente non può essere comunque disposta, ma per l’ineseguibilità della sanzione (sospensione patente) per mancanza dell'oggetto (patente).
