SOPRAFFAZIONI E SOPRUSI IN AMBITO FAMILIARE: PER LA CORTE DI CASSAZIONE SOPPORTARE IL CONIUGE VIOLENTO PUO' NON SUPPORTARE IL REATO DI MALTRATTAMENTI A volte mi rendo conto che è difficile fare questa professione quando ci si imbatte in alcune pronunce della Corte di Cassazione come quella che qui di seguito troverete. Il momento storico e sociale vede sempre di più uomini soprafattori e violenti dentro le mura domestiche con esiti infausti all'ordine di ogni telegiornale o quotidiano che si apra al mattino.
A mio avviso quella della Suprema Corte del 02.07.2010 n.25138 lascia da pensare...il tema sono le vessazioni e le percosse del marito in ambito familiare. Non mi prendo nemmeno il merito del commento a questa sentenza e lascio al Collega che l'ha redatta in rete gli onori di una puntuale valutazione e disamina del problema.

Il ricorso appare fondato.
Come è ampiamente noto, perchè sussista il reato di maltrattamenti in famiglia occorre che sia accertata una condotta (consistente in aggressioni fisiche e vessazioni o manifestazioni di disprezzo) abitualmente lesiva della integrità fisica e del patrimonio morale della persona offesa, che, a causa di ciò, versa in una condizione di sofferenza.
Nella specie i giudici di merito hanno ritenuto provati "uno stato di tensione" tra i coniugi e uno "stato di sofferenza" della B., ritenuti significativi di una condotta abituale e sopraffazione da parte del F..
Tale affermazione, tuttavia, non poggia su elementi idonei a rappresentare un'abitualità della condotta vessatoria dell'imputato.
I fatti incriminati sono solo genericamente richiamati nella sentenza impugnata, e, stando al tenore della imputazione, appaiono risolversi in alcuni limitati episodi di ingiurie, minacce e percosse nell'arco di circa tre anni, per i quali è intervenuto remissione della querela, che non rendono di per sè integrato il connotato di abitualità della condotta di sopraffazione richiesta per l'integrazione della fattispecie in esame; tanto più che, come puntualizzato dalla Corte di appello, la condizione psicologica della B., per nulla "intimorita" dal comportamento del marito, era solo quella di una persona "scossa...esasperata...molto carica emotivamente".
